CAIRO - 11 September 2023: The Egyptian law regulating human organ transplantation specifies a deterrent penalty for crimes violating the controls and provisions of organ transplantation and transplantation.
The law stipulates a severe prison sentence and a fine between 500,000 and one million pounds for anyone who transports a human organ or part of it with the intention of transplanting it in violation of the articles of the law.
If this act occurs on living human tissues; the penalty shall be imprisonment for a period not exceeding ten years. If the aforementioned act results in the death of the donor, the penalty shall be life imprisonment and a fine of not less than 500 thousand pounds and not more than one million pounds.
The law also punishes with aggravated imprisonment and a fine of 1 to 2 million pounds for anyone who performs or assists in carrying out a transfer or transplant operation in places other than licensed medical facilities while knowing this. If the act results in the death of the donor or recipient, the penalty shall be life imprisonment, and the same penalty shall be imposed. Punishment: The director responsible for the actual management of the unlicensed medical facility.
It also stipulates a penalty of life imprisonment and a fine of not less than one million pounds and not exceeding two million pounds for anyone who transports with the intention of transplanting or transplanting the transferred organ by fraud or coercion. The same penalty shall be applied if the act occurs on part of a living human organ, and if the aforementioned act occurs.
The law guarantees that the penalty shall be the death penalty if the act referred to in the previous paragraph results in the death of the person transferred from or to him, and temporary hard labor and a fine between 500 thousand and one million pounds for anyone who violates any of the provisions contained in Article (6) of this law.
It shall also be punishable by confiscation of the money or material or in-kind interest obtained from the crime or judgment of its value if it is not seized. The penalty shall not exceed imprisonment for a period of ten years for anyone who transports or plants tissue in violation of the provisions of Article (6) of this law.
It provides for a penalty of 5 years imprisonment and a fine of 300,000 pounds, or one of the two penalties, for anyone who violates any other provision of this law, and the court may rule depriving him from practicing the profession for a period ranging from 3 to 10 years.
The law stipulates the closure of a medical facility that is not licensed to perform human organ transplants for a period of 3 to 10 years, and it rules to close the facility permanently if it is not a medical facility, and to suspend the license issued to the facility to perform any operations stipulated in this law for a period of 3 to 10 years.
