CAIRO - 21 July 2023: Egypt's law regulating human organ transplantation included deterrent penalties for the crime of violating the regulations and provisions for organ transplantation.
The most prominent penalties are as follows:
1- A maximum prison sentence and a fine of between 500,000 and 1,000,000 pounds are stipulated for anyone who transfers a human organ or part of it for the purpose of transplantation in violation of the articles of the law.
If this act occurs on living human tissue, the penalty shall be imprisonment for a period not exceeding ten years. If the aforementioned act results in the death of the donor, the penalty shall be life imprisonment and a fine of not less than 500 thousand pounds and not more than one million pounds.
2- The law punishes with temporary hard labor and a fine of 1 to 2 million Egyptian pounds for anyone who performs or assists in carrying out a transplant operation in other than licensed medical facilities, and if the act results in the death of the donor or recipient, the penalty will be life imprisonment.
3- Life imprisonment and a fine of not less than one million Egyptian pounds and not exceeding two million Egyptian pounds shall be imposed on whoever is transferred with the intent of transplantation or transplanting the transplanted organ through fraud or coercion.
The same penalty shall be applied if the act occurred on part of a living human organ, and if the aforementioned act occurred on human tissue, the penalty shall be temporary hard labor.
4- The penalty shall be death if the act referred to in the preceding paragraph results in the death of the person transferred from or to him, and temporary hard labor and a fine between 500 thousand and one million pounds for anyone who violates any of the provisions contained in Article (6) of this law.
5- The money or tangible or in-kind interest obtained from the crime shall be confiscated, or its value shall be adjudicated in the event that it is not seized. The penalty shall not exceed ten years imprisonment for anyone who transports or plants tissue in violation of the provision of Article (6) of this law.
6- Whoever violates any other provision of this law shall be punished with 5 years imprisonment and a fine of up to 300,000 pounds, or one of the two penalties, and the court may rule depriving him from practicing the profession for a period ranging from 3 to 10 years.
7- Closing down a medical facility that is not licensed to perform human organ transplants for a period of 3 to 10 years. The facility shall be closed permanently if it is not a medical facility, and the license issued to the facility to perform any operations stipulated in this law shall be suspended for a period of 3 to 10 years.
